I’m a hobby artist who enjoys drawing and creating characters, mainly anthropomorphic animals, but I do also take pleasure in branching out and trying new things. • Initial Statements •By commissioning me (ie. Paying me through an invoice I send via email in exchange for an art-related service), you are agreeing to all of the terms listed below. I do advise you to carefully read through these terms, since they are final and all commissioners are held to these standards (I will not, under any circumstances, make exceptions). If you have any questions or comments concerning anything listed below, you may direct message me wherever I am able to be found, as I’d be more than happy to clear up any confusion for you! It is you — the reader’s — responsibility to understand and comply with these terms before and during the commissioning process! Thank you for taking the time to respect my practices!• General Information •Turn-around Times:
I do have a life outside of art, as I am currently a student and am employed part-time. Take note of this if there are gaps in response time. I will message you throughout the entire process to make sure that everything is to your liking! Even though I have other things on my plate, wait times typically do not exceed two weeks.Even though you have commissioned me, I still own the rights to my artwork. In other words, please do not repurpose or mass-produce my designs or creations for the sake of additional remuneration (ie. Creating clothing with my art on it, tracing my art in order to sell, etc…). The fact also applies for character DESIGNS that have been specifically created by me; you may not heavily reference or duplicate the design in order to sell.I have the right to refuse a commission without supplying an explanation. This typically does not happen, though.When commissioning me, it is required that you have a reference sheet or some other reference image/description for me to use (this applies less with reference sheet commissions, though). If there specific details, such as a certain facial expression, that you would like included in your commission, please let me know (I am not a mind reader!). I will not begin your commission until I have received your payment in FULL (to ensure people will not ghost me/drop the transaction entirely).Though I usually complete my work in a timely manner, please refrain from rushing me, as the added stress will not benefit anyone, trust me. Commissions are completed in the order that I receive them, so have patience! If your commission in particular is a priority, please contact me, as I can make that possible with a small “express” fee. Commission status can by found on my Trello (“Art Queue” button).I recommend asking to look at my art before commissioning me, or looking through the most recent images on my Inatagram page to provide you with art examples, since all artists change or improve their art style as time goes on, so things may look different! I am quite flexible with my style, though, so if you want something specific, never be afraid to ask!During the commissioning process, I welcome feedback with open arms and will make minor adjustments accordingly! Try to note these early on though, as I will not be willing to make drastic changes past the lineart stage. Once a commission is completed, it IS completed. I ask that you refrain from coming to me complaints after the fact, as I give many chances in the beginning stages of my process for you to provide your feedback.Please check your direct messages frequently, since I like to keep my commissioners up-to-date!I am currently using Cashapp or Paypal for transactions, but don’t worry, since you do not have to also have this application in order to commission me, only an email by which I can send you an invoice. You have the choice on which you'd like to do the transaction through.I shall notify you when your commission is complete, as well as send you all files complete during the commission straight to your email that you supplied for the invoice!• Art/Design Rights •Upon a completed commission (as well as receiving your artwork(s), you ARE ALLOWED to do the following:-Upload the art to an any online gallery, but please credit me in any way you can, even if it is merely typing “Proscmewtto” in the caption (I do actually have a Toyhou.se account, so your can reference my account, which is simply “Proscmewtto”).-Print my artwork so you can have a hard copy.-Display your artwork, such as using it as your profile picture or using it as decoration!Upon a completed commission (as well as receiving your artwork(s), you ARE NOT ALLOWED to do the following:-Use the artwork for personal gain (see remuneration details from earlier in this document).-Reproduce my artwork in order to sell.-Use the commissioned piece for commericial use, such as t-shirts or sweaters (this is for PERSONAL USE only!).-Claim the commissioned piece as your own artwork. This should be fairly obvious, as your are currently reading a Terms of Service document from an individual that isn’t yourself, but unfortunately this is not seen as a conspicuous detail to some.-Trace the given artwork in order to create a “base.” This is even more imperative if you commissioned my for line art only. My art is not for bases, adoptables, etc… (I do make bases in my spare time, but that is a different story entirely). I would publicly announce such a thing if I was making bases.What Are You Able to Do With Designs That Have Been Created For You as a Commission?- You may edit a design that I have created for you. Oftentimes, The custom designs that I create for individuals only show the front view, so once it is in your hands, the creative liberty is all yours!-You may commission art of this design! Have fun with it, but be mindful of what you are commissioning art of, since I do not condone actions that are deemed illegal. I shall provide the example of “zoophilic” content, since I do draw animal characters quite often. I do not support anything attached to the word, as well as other equally disgusting concepts, and if I am made aware that an individual is commissioning art of this nature using one of the customs designs that I have created, that individual will lose the right to commission me entirely. I simply want to make my art space a safe and comfortable one, so I dearly hope you understand.-I will never use my status as the commissioned artist to take a custom character back into my possession, even if an individual have broken my terms of service, since before this instance in this hypothetical situation, they sent and I received a payment in a fair and civil nature.-Typically when creating custom designs for individuals, I will make a few different variants to give the commissioner choice! I have the right to use the designs not selected by the commissioner for future projects and such. Keep in mind that my variants are not incredibly similar, as I want to avoid future issues!• Final Thoughts •Thank you very much for taking the time to read through my Terms of Service!
